These Terms of Service ("Terms") govern your access to and use of Smallbean, a pregnancy tracking application operated by Khoj Inc. ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

Service Description

Smallbean is a mobile application that allows you to track your pregnancy journey, including symptoms, appointments, milestones, and other pregnancy-related information. Your data is stored securely on Google Cloud Platform.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Subscription and Billing

Smallbean operates on a yearly subscription basis:

• Subscription Period: Annual (12 months)
• Renewal: Subscriptions automatically renew unless cancelled
• Cancellation: You may cancel at any time. Cancellation takes effect at the end of your current billing period
• Refunds: Subscription fees are non-refundable except as required by law
• Price Changes: We will provide 30 days notice of any price changes

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or other harmful code
• Use the Service to collect information about other users without their consent
• Resell or redistribute the Service without our written consent

The information provided through the Service is for general informational purposes only and should not be considered medical advice. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Khoj Inc. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

User Content

You retain ownership of any data or content you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

Data Storage and Security

Your data is stored on Google Cloud Platform with industry-standard encryption. We implement reasonable security measures to protect your information, but cannot guarantee absolute security. See our Privacy Policy for more details.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time with reasonable notice when possible.

Limitation of Liability

To the maximum extent permitted by law, Khoj Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Khoj Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
